Supervision Agreement Changes

New legislation changes the way physicians and physician assistants document their supervision agreements. According to HB 111 passed by the Ohio House of Representatives on June 20, 2018, supervision agreements will no longer need to be filed with the State Medical Board of Ohio. Supervising physicians and the physician assistants who enter into an agreement should complete the appropriate agreement application (for health care facility practice or outside a health care facility) and maintain the completed, signed forms on-site.

Massage Therapist Performance of Electrical Stimulation, Diathermy, or Therapeutic Ultrasound

Adopted by the State Medical Board of Ohio on June 13, 2018

A person who holds a massage therapy license may provide therapeutic ultrasound, diathermy, or electrical neuromuscular stimulation services when acting as an unlicensed person performing the service under the supervision of a person acting within the scope of their professional license. The person who holds the massage therapy license should not be identified as a massage therapist when doing so and the service should not be held out to be massage therapy.

Proposed Rule Comment Period Open

At this time, public comment is being sought on the proposed amended language for the following rules: 

4731-1-05: Scope of practice: massage therapy

4731-1-16: Massage therapy curriculum requirements

Comments on the proposed rules will be accepted through July 9, 2018.

Out-of-State License Verifications

The State Medical Board of Ohio no longer accepts paper applications; that includes paper verifications from other states. The State Medical Board of Ohio prefers verifications be delivered directly from the state’s regulatory agency by email
(med.license@med.ohio.gov) or fax (614.466.4331).

 Important Resources for Prescribers

The State Medical Board of Ohio and the State of Ohio Board of Pharmacy have adopted many regulations for prescribers in recent years including the requirement of ICD-10 codes on controlled substance prescriptions. Prescribers, pharmacists and supporting staff can reference this guide on HOW TO ISSUE A VALID PRESCRIPTION which addresses many of the changes.

  MMCP FAQs

  • CBD oil (whether natural or synthetic) is considered to be marijuana under federal law and, therefore, is illegal to possess. Despite what vendors may say, Ohio law does not authorize any Medical Board licensee to possess medical marijuana in the course of his or her practice. This includes the application of massage oils and creams containing cannabinoids, including THC or CBD.
  • Ohio MDs an DOs with a full, unrestricted license are eligible to apply for a certificate to recommend medical marijuana. Once a physician's CTR application is approved by the board, they should review the standards of care outlined in Ohio Administrative Code 4731-32-03. Once the patient registry is established by the State of Ohio Board of Pharmacy (coinciding with the availability of product in dispensaries), the physician will create a patient record in this portal and certify the patient's qualifying condition.
  • Applications for certificates to recommend medical marijuana can be submitted 24/7 at eLicense.ohio.gov. CTR applications are approved during the medical board's monthly meetings.

NTSB Safety Recommendation

The National Transportation Safety Board (NTSB) is asking health care providers across the country to counsel their patients regarding the effect medication use may have on their ability to safely operate a vehicle. The State Medical Board of Ohio supported these efforts with a resolution, adopted June 13, 2018. Read more about the study that prompted these safety recommendations here

Massage Therapy Update

The Westerville City Council recently voted to require all massage business to only employ licensed massage therapists by the year 2020. Please direct any colleagues wishing to become licensed to the medical board website for additional information:
